These Terms govern your use of the NAWAH store and all purchase, payment, and delivery activities. They should be read together with our Privacy, Shipping, and Refund & Returns Policies.

1. Definitions

“NAWAH,” “we,” “us,” or “our”: The entity operating the NAWAH online store at www.nawahegypt.com.

“Website” or “Store”: The website, pages, services, and tools made available to visitors and customers.

“Customer” or “User”: Any person who visits the website, creates an account, or places a purchase order.

“Products”: Dates, natural oils, offers, bundles, and all other goods offered for sale through the store.

2. Acceptance of the Terms and Eligibility

By using the website or completing an order, you agree to these Terms and the related policies.

You must be legally capable of entering into transactions. Otherwise, you may only use the store under the supervision and approval of a parent or legal guardian.

If you do not agree to these Terms, please do not use our purchasing services.

3. Store and Product Information

We aim to display product names, weights, ingredients, images, prices, and other information accurately.

Because dates and oils are natural products, acceptable variations may occur from one batch to another in colour, size, texture, sweetness, or appearance. Natural variation alone does not constitute a defect as long as the product matches its essential description and is fit for consumption.

Product images are for illustrative purposes. Colours may vary depending on the screen and lighting conditions.

Please refer to the actual packaging and product label for ingredients, expiry dates, storage instructions, and warnings.

4. Allergies and Food Use

Customers should review the ingredients and warnings shown on the product packaging before consumption, particularly if they have a food allergy, medical condition, or special dietary requirement.

Some dates may contain pits. Please consume them carefully and keep pits and packaging away from children.

Any health or nutritional information provided on the website is for general information only and does not constitute medical advice or a diagnosis.

5. Prices, Currency, and Taxes

Prices are displayed in Egyptian pounds.

Taxes are either included or excluded as indicated on the product page or during checkout, in accordance with applicable law.

Shipping fees may be added depending on the delivery area and order value.

The final price displayed when the order is confirmed will be considered the applicable price, except in cases of an obvious technical or typographical error.

6. Pricing and Information Errors

If an obvious error appears in the price, weight, description, or availability of a product, we may correct the error and inform the customer before fulfilling the order.

We will not charge a different amount without the customer’s approval.

If the customer does not accept the corrected information, they may cancel the order and receive a refund for any amount paid in relation to the cancelled portion.

This does not affect any legal rights arising from misleading information or an error attributable to us.

7. Placing an Order and Formation of the Contract

Submitting an order constitutes an offer to purchase and does not represent final acceptance by NAWAH.

A sales contract is formed when the order is confirmed and accepted for fulfilment or when preparation begins, as stated in the order confirmation message.

We may contact the customer to verify their details and delivery address, particularly for cash-on-delivery orders.

We may refuse or cancel an order for legitimate reasons, including product unavailability, inability to verify the information provided, reasonable suspicion of fraud, or a material error.

If an order is cancelled, any amount due to the customer will be refunded.

8. Availability and Quantity Limits

Products are subject to actual availability.

We may limit the quantity that can be purchased by an individual or delivery address during promotions or when stock is limited. Any such limits will be announced clearly and applied fairly.

If part of an order becomes unavailable, we will contact the customer to offer an alternative, modify the order, or cancel the unavailable portion and refund its value.

9. Payment Methods

The payment methods available at checkout may include cash on delivery and electronic payment gateways.

Customers must provide accurate information and use a payment method they are authorised to use.

Payment providers may require additional verification procedures or may apply their own refund processing times. We are not responsible for delays caused by a payment provider after we have initiated the refund process.

10. Shipping and Delivery

Order preparation and delivery are governed by the published Shipping & Delivery Policy, which forms part of these Terms.

Customers must provide an accurate name, phone number, and delivery address and must be available for communication and receipt of the order.

Delivery dates are estimates and may be affected by the governorate, public holidays, or circumstances beyond our reasonable control.

11. Cancellation, Replacement, and Returns

Requests for cancellation, replacement, returns, and refunds are governed by our published Refund & Returns Policy.

That policy takes into account the nature of food products and the consumer rights provided by applicable law.

No provision of these Terms limits any mandatory legal right that cannot lawfully be waived.

12. Offers, Discount Codes, and Gifts

Offers and discount codes are subject to the validity period and terms stated at the time of publication.

More than one discount code or offer may not be combined unless expressly stated otherwise.

Discounts cannot be exchanged for cash.

We may cancel the use of a discount code or offer where it has been used fraudulently or in violation of its terms.

When a product included in an offer is returned, the value of the discount and any gift may be recalculated fairly based on the products retained by the customer.

13. Accounts and Account Security

If you create an account, you are responsible for ensuring that your account information is accurate and that your password remains confidential.

You are also responsible for activity carried out through your account until you notify us of suspected unauthorised use.

We may temporarily suspend an account to protect it or investigate harmful or prohibited activity, subject to applicable law.

14. Prohibited Use

You must not use the website unlawfully or:

  • Upload or distribute malicious software.

  • Place false or fraudulent orders.

You grant NAWAH a non-exclusive licence to use and display the content for the operation and marketing of the store, with the possibility of removing or hiding personal information.

We may refuse to publish or remove content that is unlawful, abusive, or violates these Terms. However, we are not required to alter or remove a legitimate negative opinion.

16. Intellectual Property

The website, brand, designs, text, images, logos, and content owned by or licensed to NAWAH are protected by applicable laws.

Only personal, non-commercial use is permitted.

You may not copy, republish, sell, distribute, or commercially exploit any website content without our prior written permission, except where permitted by law.

The store may rely on Shopify, payment gateways, shipping companies, and external tools or links.

Independent third-party services are subject to their own terms and policies.

We are not responsible for the content or practices of third parties that we do not operate. This does not affect our responsibility for selecting service providers or managing your order to the extent required by applicable law.

18. Limitation of Liability

We take reasonable care to provide a secure website, accurate information, and reliable service. However, the website may be temporarily unavailable due to maintenance, technical failure, or force majeure.

We do not exclude or limit liability that cannot legally be excluded, including liability for defective products, fraud, gross negligence, or injury for which compensation is required by law.

In all other cases, our liability will be limited to direct, foreseeable, and proven losses in accordance with applicable law.

19. Privacy

The processing of personal data is governed by our published Privacy Policy, which forms part of these Terms.

By using the store, you acknowledge that you have read the Privacy Policy. Separate consent will still be required wherever applicable law requires it.

20. Force Majeure

NAWAH is not responsible for delay or failure to perform resulting directly from events beyond our reasonable control, including natural disasters, civil disturbances, interruptions to public services, decisions by authorities, or disruptions to transportation networks.

This applies provided that we take reasonable steps to reduce the impact and inform the customer whenever possible.

The customer’s right to cancel or receive a refund where fulfilment becomes impossible remains unaffected, in accordance with applicable law.

21. Changes to These Terms

We may update these Terms for operational or legal reasons.

The updated version will apply from the date it is published to future use of the website and future orders.

An updated version will not apply retroactively to an order that has already been accepted, unless the change is required by law or agreed to by the customer.

22. Severability and No Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The affected provision will be interpreted as narrowly as possible to achieve its lawful purpose.

Our failure to exercise a right immediately does not constitute a waiver of that right.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Arab Republic of Egypt, including Consumer Protection Law No. 181 of 2018 and Personal Data Protection Law No. 151 of 2020.

We will first attempt to resolve any complaint amicably through our customer service channels.

The customer retains the right to contact the Consumer Protection Agency, courts, or any other competent authority.
